Why Ratios Matter More Than You Think
Staff-to-child ratios are among the most frequently cited violations in Texas DFPS inspections. A single out-of-ratio moment — even for a few minutes while a teacher takes a break — can result in a deficiency citation. Repeat violations can affect your star rating or license status.
The ratios below are the minimum standards required by Texas Administrative Code Title 26, Part 1, Chapter 746 (Child-Care Centers). Your own license may specify stricter requirements.
Staff-to-Child Ratio Table by Age Group

Mixed-Age Group Rules
When children of different ages are grouped together, Texas DFPS requires you to apply the ratio for the youngest child in the group — not an average.
Example: Mixed Infant/Toddler Group
If your classroom has 2 infants (0–17 months) and 4 toddlers (2 years), the entire group must meet the infant ratio of 1:4. With 6 children, you need at least 2 staff members present at all times.
Transitional Age Groups
Children who turn two during the program year may remain in the infant/toddler room or move to the toddler room. Once 50% or more of the group has turned two, the group must meet the toddler ratio. Document transition dates for each child.

Group Size Limits
Maximum group size is separate from the ratio. Even if your ratio is met, DFPS caps how many children of a given age can be in one group. The table above shows both requirements — you must meet both simultaneously.
Why Group Size Matters During Field Trips
Group size limits still apply during field trips, transportation, and outdoor activities. If you take children off-site and mix age groups for convenience, you must meet the ratio and group size for the youngest child present.
Counting Staff: Who Counts Toward the Ratio?
- Counts: Lead teachers and assistant teachers who are actively supervising in the room
- Does not count: Directors doing administrative work, staff on break, volunteers without a completed background check, substitutes who haven't completed required orientation
- Does not count: Aides who are not yet 18 years old cannot be counted as a ratio staff member without a qualified caregiver also present
Naptime Ratio Exception
During scheduled nap time, DFPS allows a reduced ratio for children 2 years and older — as long as a caregiver is immediately accessible (within sight or sound) and can return to the room within 3 minutes. The reduced ratio is one staff member per 26 children for school-age groups. For children under 2, the standard ratio applies at all times.
Preparing for DFPS Inspections
- Post your current enrollment and daily attendance roster visibly in each classroom
- Keep dated records of any ratio adjustments when a child's age group transitions
- Document substitute assignments with start/end times and rooms covered
- Maintain backup contact lists for on-call substitutes — unexpected absences cause the most ratio violations
